Terms and Conditions

Registered Users

First of all, let me clarify what I mean by a registered user. A registered user is:

someone who has registered one of my programs with me (such a registration is FREE and totally confidential) eg. Canary or ExitWin, or
someone who has ordered/bought one of my programs from me eg. Canary Pro or E-Diary Gold.

Registered User Benefits

With all my software, once you become a registered user, then you are entitled to:

FREE continual e-mail support: you can ask me for help at any time over the course of your use of the software. I only ask that, when you send me an e-mail with your query/message, that you include in your e-mail:

your registration name,
your program key,
the name of the program that the query refers to.

I have built into my programs (or will if I haven't done so yet!) a menu or a button option that will create a new e-mail message addressed to me with the subject line already filled. All you will need to do is type in the main text box the information above and your query.

FREE upgrades and patches: your registration details will work for all future versions of the product you registered. For example, if you purchased E-Diary Gold 1.35, then you will have been sent appropriate registration details. It is my current expectation that your registration details will be valid for all future versions of E-Diary Gold which you will be able to download from my site (once available),
bug fix: should the program you purchased/registered have a bug in it, I will do my best to fix the problem promptly and send you a copy of the program with the bug fixed,
refund: if you have ordered a program and you are not satisfied with it, then let me know and I will arrange a refund for you - no problems!
suggestions: I take all suggestions for my programs seriously, and I will implement the ones that I can into future versions of the program. Please note that because I work full time and do this in my spare time, such upgrades could take some time!
spyware and adware free software: I can assure you that all my software is spyware and adware free. I do not support the role and the use of spyware software as I consider it to be an invasion of one's privacy - especially if it is incorporated into a program that is then installed on a computer and the user has not been made aware of its presence. If you find that the installation file of any of my programs contains spyware software, then please let me know as soon as possible!
virus free: I expect my software to be virus free as I regularly download the latest "patches" for the anti-virus program I am using,
registration/purchase details privacy: let me assure you that your registration/order details are kept with the utmost confidence. I will not give or sell (or anything else) them to anybody and for any reason. In fact, once I receive a registration/purchase application, I process it, I print it and then I store it in a safe location. Consequently, registration/purchase details never leave my room and are never made available to any one else - for any reason!!!

Terms and Conditions

distribution

you may distribute any of my programs as long as they are not the registered or the purchased version ie. you are only allowed to distribute the free unregistered versions,
you are not allowed to charge for the distribution of any of my programs unless they are part of a compilation of programs from several different authors eg. Canary could be distributed on a CD that contains security software from several different authors, or a shareware/freeware CD, . . .
when you distribute any of my programs, they must stay in their original forms ie. you may not alter any files, you may not delete any files and you may not add any files to my distribution file,
when you distribute any of my files, you may not distribute with it any registration details that a user could use to register the program without getting his/her own registration details from me,
you may not rent or lease any of my programs,
you may not sell single copies of any of my programs,

licence, installation and use

when you purchase a program from me, you are granted a non-exclusive license to use it on as many personal computers, desktops and/or portables as the purchased licence states,
if you have purchased the one copy of any of my programs then you may install that one copy only on the one computer,
usage on a LAN or in a server/workstation environment requires that each workstation accessing the software must be licensed,
whatever licence you have purchased from me, you cannot sell it, give it away, lease it or rent it or transfer it to any other organization/company, group of users or single user,

short version: DISTRIBUTED "AS IS". NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE AT YOUR OWN RISK. I WILL NOT BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE,

although I have done my best to check that all my programs are free from bugs and viruses, I cannot guarantee that they are,
you may not defeat or try to defeat the registration and the password entry procedure/algorithm in order to avoid registering/purchasing any of my programs,
you may not use, copy, emulate, clone, modify, decompile, disassemble, prepare derivative work, otherwise reverse engineer any of my programs,
all rights to any of my programs are exclusively owned by me, Serge M Botans,

When you install any of my programs on a computer, you acknowledge that you agree to the terms and conditions detailed on this page. If you do not agree with the terms and conditions listed on this page, you are then required to cease using the program and uninstall it from your computer(s). Any unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.
